Estate Administration and Claims
We act for and advise trustee clients on their administration duties. We have have an understanding of the Family Protection Act 1955, The Law Reform (Testamentary Promises) Act 1949, and the Property (Relationships) Act 1976 and their potential impact on wills and estates. We act for estates, beneficiaries and claimants in estate litigation.
Relationship Property
We advise clients on their rights and positioning under the Relationship (Property) Act 1976 as is with the Estate Administration. Advising them on what is relationship property which includes the family home, car, household furniture and appliances (even if one person owned this property before the relationship), and all property acquired by either partner during the relationship. We assist in both private negotiations and court proceedings.
Powers of Attorney and Property & Welfare Orders
We assist clients with executing Powers of Attorney and also assist with applications to the Family Court for orders where there are capacity issues.
Family Law
We act for and advise clients in all aspects of Family Law, including Court proceedings under the Care of Children Act 2004 and
Family Violence Act 2018.
